If it follows previous precedents for these type class action suits it will. Until the settlement is finalized no one will know.
They also neglected to include the 2006 T6 XC90's but that will likely be addressed.

2008 ago bought my wife a used 2005 XC90 with about 45K miles on it as we were moving from the lower 48 to Alaska and wanted a reliable AWD for her. I already owned a Volvo S60 and prior to that a S80. Obviously fond of the Volvo brand.
As most of you already know Ford bought ownership into Volvo and then decided to install a GM transverse transmission into the XC90. Not pleased that any American car manufacturer should be dabbling in any European car...and yes, I'm American!
2010 and now about 60K on the car my wife calls me that the message board was displaying a message about the transmission. By the time I arrived home the message was gone. We swapped cars and I drove it to work the following day. Sure enough on the way home the message appears and the car goes into Limp mode. I "limped" it to the dealership at a mere 10 mph. Left it at the dealership for their diagnostics and within a day was informed that a new tranny is about $5,800 (Alaska prices, yes!). Imagine my surprise having a new 2 ton paperweight.
All is not lost and let's thank Al Gore for the internet!
I researched this problem online and found others having the same issue. I decided to call Volvo customer service in New Jersey and portrayed to them my dismay of the XC90 and took the "Volvo for Life" literally albeit, there are various interpretations. After spending several minutes discussing (cordially) our dilemma and that I was not very appreciative of a Volvo product failing at 60K for this long time Volvo owner (11 years).
Volvo said they would speak to the dealership and collect information about our XC90 prior to making any decisions. Well, to our surprise Volvo customer service called back after 3 days and informed me that the transmission would be replaced at no cost. Yes, I did pinch myself thinking missed a major bullet there. Not sure why it was decided to repair our Volvo but suffice to say my wife and I were pretty happy about the outcome as you can imagine.
Hope the outcome for you folks having the same issue is replicated like ours.

There was a very short list of transaxles capable of the torque of the twin turbo 6 and the GM built gearbox was available in numbers to support the production. At the time the 4T60/4T65 was a gearbox with good reliability. The commitment to this gearbox probably predated the Ford purchase 4 years or more as commitments for components usually run 3 years in advance of the start of prouduction. SOP was in 2 quarter of 98 and Ford bought Volvo in 3rd quarter 99.
Volvo could have gone with ZF but their transaxle that could have been used has a bad, maybe worse, reputation than the GM box. Aisin-Warner didn't have a unit with the capabilities near to production then.
It is great of Volvo to assist you. It would seem they are not blind to the issues.
