What are my rights for this recall?

Do you have a failing Electronic Throttle Module? What steps to take if you do, plus the latest ETM news. Volvo 1999-2002 models only please.

I just bought this 2002 S60 about a month ago and it is idleing weird...it will rev and stall at stop lights and if I slow to take turns. I have replaced a couple sensors and it is still acting crazy. What rights do I have in regards to this recall? I live about an hour from the nearest Volvo Dealer so I really can't take it in there everytime something happens...but the mechanic I have been working with that has told me he thinks it is the Throttle body. He has worked on volvos for several years. Thanks for any advice as to what I can an can not do.

Is your S60 a non-turbo engine?

sorry forgot to say that...it is a non-turbo with about 110,000 miles.

That 2002 model does have an ETM and is under the 10 year/200k mile ETM warranty.

can I tell then I want it replaced even if they say they don't think it is causing the problem?

first go to the dealer and have the codes scanned as well as checking for any open campaigns on this car it may simply need the software updated that was recall 155 the 10yr 200k warr is from date of org dilevery which my be up already so dont delay and get it to the dealer asap a etm is a 1k plus job if you have to pay

No you can't ask them to replace it anyway.
As Doc said, they will do the software update if it doesn't have that software already. They will have to check a few things and may find some issues that are not covered by the extended warranty. Stopped up crankcase breather system is not warrantable but is a maintenance item that can cause excess oily vapors to accumulate in intake and on the throttle blade and make it stick. If there is a problem like that then it must be addressed in order for the throttle to be tested and to be warrantable. The Software enables a commanded test that yields results that must be included with warranty claim. The test can have results that point to things not the fault of the throttle and those are not reasons to replace the throttle.
If the throttle is replaced and the other issues exist you could have the same problem after a new throttle is installed. The manufacturer of the throttle is not responsible for the items outside of throttle failure. I am in no way saying that the throttles do not have failures, plenty of failures. I am just letting you know that the throttle warranty is not responsible for the maintenance items of your car.

I unerstand that but if there is a recall on the part I would want it replaced so that the chance of it going bad right after the warranty is eliminated.

There isn't a recall on the part. There is an extended warranty. There is a reliability of function software that is a recall.
