A somewhat inflammatory piece.

I suspect that the party to the referred action checked, and found that the engineer in question was not licensed, and the government then had to investigate.

Just because no money changes hands does not mean you are not practicing professional engineering so he may not be in the clear here. The fact that his consult was material in the lawsuit legally clouds this.

By analogy, if I give medical advice to someone in a lawsuit which they used, I’m in trouble.

The easy path to fix this is the plaintiff simply having his calculations examined and verified by a PE licensed inNC, not an emotional first amendment play.

Seems the States' objection is providing expertise without the required permit, so I agree, a First Amendment argument does not obtain.
In any event, if he was trying to help a neighbor with a flooding problem, it shouldn't have been colored by his Chemical Engineering degree, it should have been couched in terms of a Concerned Citizen. The folks trying to bubble this to the top of the pond seem to be using this matter as a fund raising tool.
