Incompatible Software Upgrade

I took my 99 S70 AWD to the dealer for the ETM Software update Recall 155, well they gave me back the car and told me they couldn't communicate with the ETM and the car was saying incompatible software, therefore they are unable to perform the recall. My throttle body has a yellow sticker, therefore it HAS been replaced, but other than that I know nothing. Perhaps someone else installed this yellow sticker throttle body, and they didn't load the correct software from the start? I want this recall performed because the car has trouble starting, so I am trying to narrow down the problems. This is the SECOND time I have taken it to Volvo for the recall the first time I had a check engine light on, and they blammed the communication failure on that, so I fixed what needed fixing, and this was my last step. WTF? I have a good feeling now they are playing games.
