didn't have time to work on Volvo last night going to try and jack it up after work today I will keep posting the progress....

sounds like it isn't in park like it is starting in neutral
also like two problems parking brake pads have fallen apart and are binding

So checked the transmission fluid it is fine didn't smell burnt not gritty looked normal. checked all the fuses all good. since it is a front wheel drive should I still try and spin the back tires? When the car is in drive for a split second it wants to go but quickly binds up? If it was a brake problem shouldn't the car still be able to move when in drive? It starts in park and runs well just wont go. If it was able to go in drive wouldn't a front wheel drive car be able to drag the back tires if they were locked up with a brake problem?

Parking brakes are drums in the rear rotors.
Very common for the lining to delaminate
from the shoes and cock up the works.
As suggested - Get it up in the air and be sure.
Spinning the fronts in neutral will also answer some questions.
Have you followed through with checking the PNP bell crank indexing?
( At the end of the shifter cable on the transmission).

If you put it in reverse, do the reverse lights at least come on? If not, suspect the PNP switch or the linkage. The PNP switch could still be bad, but that's a good basic test to start with.
+1 on checking rear brakes - though I think it should still be able to drag it with the brakes applied. I know when both of my front calipers ceased I was able to drag her to the garage - with smoke billowing out... Ah, the smell of burning friction material in the morning.
When was the last time you used the e-brake? Sounds like a stupid question but the less often it is used it seems like the more likelihood something will happen when it is used that is undesired. Often happens after letting someone else drive the vehicle if you never use it. My wife doesn't use the e-brake ever and when parking I do often. I have had several vehicles where the ebrake bound up as a result of her driving it for almost a year without using it. I believe the cable corrodes/deforms and then gets caught in the lining.

that's funny I hate that smell.... if it were a brake problem should it still be able to go in drive?? going to check PNP as soon as possible...A friend is going to let us use his car lift but he has a car on it right now so hopefully maybe tomorrow or the next day? I will keep posting. I just so badly don't want it to be the transmission haha

PNP switch is what lets the transmission computer know you're calling for drive or reverse. My understanding is it will not actuate the solenoids for you to move (engage a gear) if it doesn't detect a valid call for movement. If you determine it is at fault, I would suggest getting one from a dealer or a PNP if money is an issue. The aftermarket ones for our vehicles tend not to work or last based upon other forum posts.
