I have names, pictures, witnesses, phone documentation --everything-just FYI--Although everyone agrees I have a complaint--no one wants to get involved, or it's not their jurisdiction-been everywhere and am financially drained.
My car was due back in (still is) on a lease--the car is in unbelievable condition-I paid for 15,000 miles a year for 39 months and I am still under warrantee and shouldn't have even paid for the extra miles-never been in an accident --just two scratches from parking lots-although I never park next to anyone -they were windy carts at best.
My car is maintained --over maintained and everything according to records has been done whether it needed it or not!! No one ever even sat in the passenger seat, back seat or used trunk--no tickets and no one ever drove the car (Volvo 2001 S40)
4 weeks before end of lease-(already ordered a new car from dealer-obviously cancelled) --financially drained, the car without warning died on freeway entrance in the desert near my home, (finished garage and driveway--no leaks or spots) towed it home and couldn't figure out what was wrong-towed it to deal--not my own -roadside would not allow it-had to go to closest dealer which was a new dealer for Volvo--found it was gasket in engine-which seized--again no gage warning no leakes no smoke-Police and tow were there-we all thought battery cable lossened-Dealer Manager asked me to volunteer to my insurance company the fact that I intentionally ran the car without liquids to burn it out or I ran over something that jammed the engine--no damage--I refused he wanted between $7,000-$25,000 from insurance for gasket still under warrantee by 2 years and over 10,000 miles-I suspected his illegal actions and asked for him to release my car for 3 days I'd tow it out-he refused--when I asked for Volvo tech I stayed there to wait for one for 3 days-no one showed up.....apparently after work hours pictures were taken of my car and overnighted to corporate--not aware of course when I came back the front bumper was smashed at the dealership in several places-apparently they painted the bottom with red-I didn't see it the Corporate office told me weeks later that they received colored photo's taken after hours of a vehicle that had gotten in an accident---They now wanted $17,000-$25,000 to fix at dealer and would post my Vin as not to give me any service at any Volvo dealer-called everyone-car information and documentation is contradictory to what they did and said-Volvo intentionally did this on a weekend after hours and refused me my car for days and pushed me out the door literally..........I have spent thousands repairing this car and used a second loan and the car's book value is only $14,000 so where they get off trying to committ insurance fraud for more is beyond me they said that if I didn't pay them they would not allow my leasing company--also Volvo to accept the car back even if the parts were all Volvo's -no one will get involved --it's much worse then what is stated here but all the evidence in the world is useless if no one helps-This cars warrantee is voided for no reason all because one dealer decided to commit fraud and now Volvo is backing them up. I can prove everything if some one will listen it seems to be no ones jurisdiction and a lawyer doesn't take this on contingency--I do not have the $ at this point to do anything let alone get any kind of car.
Please help--they should be in jail let alone in trouble-they told me they have two discretionary tactics to avoid warrantee items-#1 say the person was in an accident-whether they were or not #2 say the person intentionally ignored warnings or tested the car beyond it's capacity for fun.

Assume this is going to court, even if you don't have money. You've already tried the normal routes to deal with this problem and they've shafted you. From your writing you seem to be very emotional. That is normal. To see this through and come out on top, however, you're going to have to forget emotions for a time and become Spock (you know -- the guy with pointy ears from Star Trek who's the logical guy).
Spock is all about logic. He deals with the facts, and only the facts. That's going to be you. Ok, back to the plan:
First, don't let them know you don't have money for a lawyer. If you look weak they'll just keep up their story. Tell them you're obtaining legal cousel. Use those words. Let them know how to contact you in case they think they might get caught in this insurance fraud and change their minds about the whole thing.
Second, write everything down in chronological order. Write the dates on the left, write what happened on the right. Get everything down... people's names at the dealership, at Volvo North America, insurance adjustors, friends that can back up your story about being a careful driver. Write all those names down. Call your insurance company and ask for a copy of your records to prove you are a careful driver. Call the tow truck company that first picked you up that day. Get the name of the driver. Write it down. Talk to him and see what he says. Write that down.
Get a folder and put everything related to this case together in one place.
You have pictures. These are very important to your case. Make copies of them and keep the originals in a safe place.
Do you have any friends that are lawyers and can fire off a letter to the dealer with the law firm's letterhead? This is sometimes enough to turn the tide.
Do these items and post back here to follow up with your situation.
