Thanks for your work on this issue and taking on this forum.
Three questions:
1. Do we have accurate information on the milage of the warranty? I have read that the initial 200K will be reduced to 100K when the letters are mailed out.
2. Can you provide any information on surging? Is it more common that the cars stall when the ETM fails? I experienced stalling but have read online about surging and that sounds even more of a safety issue than stalling. Would there be any indication in advance that a surge might occur?
3. Is NHSTA still contacting owners who file reports regarding the failed ETM? I would like to talk with the investigator if they are still taking information. Who would I contact or should I wait for them to contact me?

1) Dan Johnson's letter to Tony Kovaleski, to be released on the ABC Channel 7 in Denver said 10 years or 200,000 miles twice. I have another source that confirms that. I doubt that the 100,000 has any verification behind it.
2) Four failure modes have been verified. In the next couple of weeks, I'm out of town now, I will post what I know at VEXEDvolvo.org. I have confirmed couple of ETM that stick and cannot be closed below the limp home mode so that leave you sitting at a stop sign with your foot hard on the brake.
3) NHTSA is still taking reports. If you have not sent in a report do so. See VEXEDvolvo.org under FAQ. Rather than me put out his e-mail send me your story and I'll forward it to him. I know they are expecially looking for report of stalling with NO prior symptoms, lights, messages, etc.
We have several concerns;
How do we get the message across that the car is acting up even if the dealer cannot duplicate it and if there are no codes set?
We have to make Volvo that stalling is a safety problem. They cannot help but know it, they are just repeating the company line.

Does anyone know if this new ETM extended warranty will apply to a used Volvo? Meaning can I take advantage of it if I'm not the original owner? I have a 1999 Volvo XC which I love, but the ETS/Check Engine light just went and can only "limp home."

So far as we can tell you are covered. If you have gone to the limp home mode a code should have been set. Take Dan Johnson's letter with you, see "vexed won" at vexedvolvo.org. Therre has been no mention of 'original owner'. The main concern is if there is no code found. I think that is the next big fight.

Thanks for your reply Don, your work on this matter is much appreciated. I'll let you know if the dealer gives me any kind of grief for not being the original owner (even though the car has only had one owner, and he spent $900 replacing the entire ETM and throttle body only 2 years ago).
