Burned fluid ... NOT GOOD at all
They may be right in this case, once the fluid is burned it means little parts and pieces also were burned!

Thanks JRL, I've read a bit about the burnt smell meaning a flush/change would do some fixing, does that sound possible or maybe it's too late for my wheels?
I took it for a drive and noticed that basically it changes up and holds gear very well, but won't drop down gears. So if I'm cruising in 4th and then come to an intersection it won't change down. I turn the ignition off, sit for 20 seconds and start up and it finds 1st again. Very odd...

Too much fluid can be as bad of a thing as too little fluid.
I would suggest dumping the pan and filling it back up again at least once to see if matters improve at all.
Your car will take 3309 fluid.

Great, I'll give it a go and report back.
3309 is almost impossible to find here in anything less than 20L drums, but I'll give it a go, obviously nothing to lose at this stage!

UPDATE:
Wish I could be posting results here, but I can't even get the car to drive far enough to get to the auto store to get some fluid!
I've had a telephone diagnosis with a transmission specialist, and they say that I've got a clogged filter, based on my symptoms which are drives fine for up to 2km or so, then flares and loses drive. I pull over turn off ignition for 30 seconds and off I go again for another 1-2km then starts again, getting progressively shorter drive time. They said the stuff is getting circulated and blocking the filter, then settling when I pull over.
Question is: does this mean I need a full flush, or even a 3 x drain and fill, or is it too far gone? They seemed to think it miiight help for a little while but in the end wouldn't solve anything. Seeing as the filter is internal, would a flush clean it out at all?
Wish I could be posting results here, but I can't even get the car to drive far enough to get to the auto store to get some fluid!

this tranny has an internal filter, not accessible unless you pull the tranny.
Go to the toyota dealer and get a case of type IV fluid. Also get 2 cans of seafoam transtune fluid.
Add 1/2 can of seafoam(8 oz) to the tranny. Drive the car for about 200 miles.
Do a drain and refill with the same amount that drains, about 3.8 quarts.
Add the other 1/2 can of seafoam and drive the car another 200 miles and do drain and refill.
Repeat one more time.
Go to the toyota dealer and get a case of type IV fluid. Also get 2 cans of seafoam transtune fluid.

Do a drain and refill with the same amount that drains, about 3.8 quarts.

I called toyota and it's $54 for 4L of fluid, and I can't even find SeaFoam here in Oz. Three drain and fills will cost me the same as it'll cost to have the transmission taken out and properly diagnosed (with a free tow courtesy of our friendly road service people) by a transmission specialist, so we've gone that route.
While the road service folk were out here, they read off the dreaded P0735 and P0740 codes, so I'm guessing I'm not getting any good news from the transmission folk... Should have done my research before buying this model@

Is this a P2 body or older style P80? Regardless of which you still have the AW55-50SN gearbox. A valve body direct from Texas Volvo (one of MVSs sponsors) will set you back around $1,300 shipped plus fitting.
I also have an early five speed in a P80 series 2000 V70 (gen 1 body) with transmission flaring from 2nd to 3rd gear but it still goes well. There is also a B4 servo cover update which can alleviate many shift problems. Be sure to have a dealer reflash the TCM to the latest firmware to get rid of the false neutral in drive (if you have it)
You can use Nulon synthetic in this 'box (it passes Toyota IV) and this will help to protect it in the future.
If you have a choice and it appears you will need a new valve body insist on the later '03 valve body to be fitted. These can go in with a modified loom kit for the differently oriented solenoids.

It's a P2, and sadly I'm in Australia where it seems parts are ridiculously expensive. New valve body here fitted is $4500 or more.
I did see Nulon synthetic at the online store and considered it, so hopefully if that's a possible remedy the transmission boys will be able to take care of it.
To be honest I'm likely to get a used transmission fitted and just get rid of the car and go back to the 940s I've had in the past!
