03 V70 2.4L 3rd Row Seat

The 3rd Row Seat on our Wagon is not latching on the right side. I just noticed it and I can't recall if its always been like this...it appears that the locking mechanism on the right hinge is not dropping down to lock the seat. The left side locks out. Has anyone noticed the same issue? Or is it designed that way? Thanks.
