My brother just bought a 2001 XC with 110K miles with Scorpion tires & it was checked out and seem to have a clean bill of health. However, on uneven icy or slick surfaces it seems to spin the passenger side rear tire suddenly and then feels unstable for a split second. I checked the tires and the 2 rear tires seem to have some uneven wear and the driver side rear tire has more wear then the PSR. Somewhat like they were left on the front with an alignment issue. The cars rear axle will pull right then it seems like the suspension will tug the axle back to the center and rock the body making it feel loose. Any ideas on what might cause this condition other then the worn tires?

The XC cannot have tires that are worn unevenly. I'm willing to bet that buying a set of 4 new tires will fix your problem unless the 4WD system has already been messed up by the uneven tires.

"other than the worn tires." Excessive toe in on the rear tires could set up a false skid situation. The other day I saw a Jaguar with the front tires in fine condition and the rear ones were almost completely bald. All tires were installed at the same time and had never been rotated. Do a wheel allignment

If the "uneven" tires have been on for a while, the odds of your AWD system being messed up is very good.
