Check Stop Lamp 2006 xc70

My 2006 XC70 shows check stop lamp message, the issue is,

The top (3rd) Brake light always works, but the 2 side lights are not working under the following conditions
  • When the car (from off) is set to pos2, the brake lights work
  • when the car engine is turned on, the check stop lamp message appears only when pressing the the brake pedal
  • When the car is set to pos1 to turn off the engine, and set back to pos2, the issue persists (the car never turns all the way off)
  • when the car is turned all the way off and set to pos2, the lights work again
I have looked at other entries on the forum, and only see the relay fixes, but 2004-2007 models don't have relays.

If someone could help me diagnose what is going on that would be stellar, currently I suspect an issue with the REM,

All the fuses were check and are still good in the REM as well, and I traced ground from the bulbs and that also appears to be fine

Update: It looks likes it is only an issue when the car is on after more testing.

I hate electrical problems but lets consider it logically,

As the stop amp above the rear hatch always works, that pretty much rules out relays and modules.
I can't imagine the center stop lamp running on its own dedicated circuit.
So it shifts the source of the problem to the wiring harness and lamps themselves.

The sockets can develop resistence and cause trouble.
But the harness passing through the hinge area is more often the bigger problem.

Put a stick on the brake pedal and brace it against the seat to keep the brake pedal depressed,
try jiggling the wire harness at the rear hatch hinge area.

The high level brake light is the only one that is working and it is in the rear hatch. The 2 others are on the rear body of the car so unless the wiring somehow goes to the high level light and splits to the 2 rear lights it would suggest the issue is somewhere after the 2 parts of the brake harness separate.

Also check the bulbs and the connectors themselves. I have had both fail and strangely only on the brake lights.

What is strange is the failure mode that it is intermittent operation only on the rear lights and not the high level one.
