I received a recall notice from Volvo about new software to be added.
made an appt. after tech downloaded new software I was informed it had crashed and my car now was undriveable .the only solution I was given was to replace the ETM and my ten years was up 7months ago, only 84000 miles on it. but because the time was up Volvo said I had to pay for the ETM 1000.00
I had no options since the car ran fine when I brought it in.
Either tow it away or pay them 1000.00 which I reluctantly did.
how can I get Volvo to pay me back?

Software crash while downloading is not common, but it can happen. In your case it happened during ETM download. Inexperienced technician will condemn the ETM as defective, because he does not understand exactly how software is loaded in to CAN network.
With out getting to technical, when the download got rejected all he had to do was to disconnect existing ETM and plug in any old ETM kicking around (Your existing ETM is still bolted in the car). Perform download then reconnect your old ETM back and do a download again. At the most you should pay for double download that is it.
I would ask the dealer for your old ETM to be installed back in your car and software downloaded. To your and his surprise car will accept the download without any problems. Try to be present during this procedure as your ETM could “drop on the floor” before goes back to you car.

There's this legal feature called "Small Claims Court" that actually works pretty well, and you don't need a lawyer. But if you consented you may have difficulty. I would have declined the "repair" had it towed to a Volvo Indy, fixed, and then present the dealer with a bill followed by a summons. After all they DID break it. It also helps to inform the various consumer watchdog groups of the complaint. It's the squeaky wheel effect. Call this # 1-800-283-0117 from this web page http://www.etmsettlementdocuments.com/2008/faq.html and complain loudly. After all, they broke it. They might let you keep the new ETM at no charge. Doesn't hurt to ask.dales s70 wrote: how can I get Volvo to pay me back?

On these non-CEM cars, in theory at least, disconnecting power to the car for 1 minute, re-powering the vehicle and then ordering an ETM reload for the car should take care of it.
