xc90 2007 fuel guage problem

I have run out of gas twice even thought the display says i have btw 40 to 60 miles left till empty. the dealer cannot find the problem and/or does not want to fix it unless there is a code error. Any suggestions on the problem. They have recalibrated and updated the software. I the measurement device is working, just not accurately. It will cost $600 to fix unless i can prove that it is broken and should be covered under warranty

That is pretty sad. If they can duplicate the problem and the car is under warranty, there is no need for there to be a trouble code in order for the part to be replaced under warranty. Don't know what to say, other than maybe take it to a different dealer, or contact Volvo directly. If it's under warranty and the car is leaving you stranded, I would demand some answers.
