Wow, this is all so new. I have a S60 T5, with 58k, the auto transmission started "jerking" into both foward and reverse and when making 1 thru 2 change. Local dealership did software upgrade , { for which i paid

Print the stuff out from Don's site and from here and take the material to them...the letter from the UK (above) should be convincing too. If that doesn't work, then write a letter to Volvo of Britian?? (not sure who the authority over there is, but go higher than your dealer). Good luck and let us know how it goes!

Update:-

Ok, called dealer, this morning, explaining my problem and grievence.
They were understanding[to a point]. It was then i let go with my knowledge, about the ETM problems......will call you back!!!!, 10 mins later i can bring the car right in!.
whent for a drive with the guy who had fitted the ETM 3 weeks ago, now said it was the tranmission and would be

Good deal! In the meatime, Don is researching the ETM & Gearbox failure relationship...read as much as you can about it before talking to them again. Good luck and keep us posted!

.......... Once back at the dealership he tells the service manager who says right off the bat , that volvo would pay 40 % of the cost....

...........again i tell him about the what i know and all goes silent.... he needs to speak to dealership.

It's CRIMINAL the way they obfuscate and deny, and then once they find out you've caught them in a LIE, they get pleasant and co-operative.

Not only should they pay for known defective design problems (ETM), but they should cover collateral damages (Xmission), as well as civil damages for outright LYING, stalling and falsely blaming customers.

Volvo is down the crapper. Legendary Lip-service.

Thanks for the support.......it's helping alot.
to think til this weekend, and without this and Don's site, i would of gone to the dealership today and have payed FULL price for a new tranmission and would never of questioned the ETm cost!!!!!.

One of the things that got this all rolling was Volvo's "Secret Warranty". It was the basis of a lawsuit against Volvo, whereby in secret dealer documents, they were authorized to repair an ETM for free, but ONLY IF the customer demanded such action (usually loudy) , otherwise, charge them for it.

This legal action caught some added momentum from the CARB (Calif Environmental group) and was the final straw that FORCED Volvo to offer the extended 200K/10y ETM warranty.

In my case, Dwayne (Service Mgr) falsely blamed me for using "cheap" fuel and failing to properly maintain the air filtration system. Funny, because I had ALL MY SCHEDULED maintenance done at the Volvo dealer garage, and I always burned the best fuel in my C70 ... who wouldn't?

Then I was told, "Parts fail, get over it", and when I told him about the "Secret warranty" lawsuit, he denied knowledge of it. Of course he had read about the Throttle body cleaning TSB (which he said never fixed the problem), which was in the same "Secret warranty" document.

Volvo is thick with Lies over this entire thing, they knew this series of ETMs would fail prematurely in late '98, before any of the affected vehicles ('99-'02) were ever shipped and sold. There is a rich paper trail of their denial to acknowledge this was a problem ....

Don't let 'em steamroll you ... if you can't get satisfaction at the dealer, call Volvo Cust Service, Susan Campbell (201) 768-7300 x1983 (?) ....

.... AND register your complaint at www.NHSTA.GOV .....
