2003 S40 P0128 Code will not clear

Need some help here folks this is driving me nuts.
I have had multiple issues and seem to have gotten everything going but...
I now have a check engine light and after going to the local shop and having them read it It is a P0128.
Thermostat issue. Honestly I do not believe it because I can't get the check engine light to clear.
I unplugged the battery for almost 24 hours and the light does not clear. This is not an issue which would automatically pop up and I'm wondering if I might have a computer issue.
Does the shop need to clear the code ?
Would a bad thermostat throw a code immediately ? I'm thinking it would not pop until a certain temp.

There is a software upgrade for that.
It is called a VEMS upgrade and is resident in VIDA software, i.e., it is not a purchased download.

Dealer or indy shop with VIDA.
I'm not aware of other equipment having that capability.
