My transmission seems to hesitate before going into gear when I shift from park to drive. Could this be due to low fluid levels in the transmission? If so how can I add/check fluid levels? tranmission seems to run fine other than when shifting into drive. Any insight would be great.

You have to push the intake hose aside to find the hidden dipstick, then you should flush or at least drain and fill the transmission unless the fluid is red (which I doubt)!

Volvo upgrades software usually every 6 months or so. There were at least TWO upgrades for 2002's
I had the software update recently performed. It is a huge improvement over the old sw. It will still jerk into gear in the morning unless I rev the engine a little in neutral before shifting into drive. All other issues are resolved. The shift flare is gone. The cold shift into drive problem is I believe one of the shift solenoids and should probably be replaced. I think I will just live with this issue as I don't think it will affect the performance or longevety of the trans.
